At least the Hindenburg stamp is in copyright (de:Karl Goetz). It may be argued that de minimis applies, but the way the file is used in articles speaks against that (the stamps are the subject of commentary). Rd232 (talk) 15:19, 31 July 2012 (UTC)
- I think you are right that one cannot use de minimis as a defence for using an image in a context where the copyrighted element is the central one. But that is an issue with the use of the image in Wikipedias. To my understanding the image is OK for Commons, as it can be used to illustrate e.g. postal delivery paths, where the stamp really is de minimis.
- (Similarly we have lots of images of parks with statues, where FOP does not cover the statues; captions should not discuss the details of the statue as seen in the image, but rather the placement of the statue.).
- This is something not often mentioned in policies and guidelines, neither here, not in the Wikipedias, but legally the situation is probably quite clear.
